This page (together with the documents referred to in it) contains the complete terms and conditions that apply to all the activities (include visiting, joining, buying, etc.) you will make on PARTY CONE (hereby referred to as 'we', 'us', 'our website' or 'the Site'). Please read them very carefully before using the site as you acknowledge that you consent and agree to abide by these Terms and Conditions, even if you are browsing and have not registered. PARTY CONE is a website owned and operated by Twinkling E-commerce Company Limited, a company registered in Hong Kong. 

2. Placing an order

By placing an order through our site, you warrant that:

2.1. You consent and agree with our full user Terms & Conditions. 

2.2. You are at least 18 years old

2.3. You will receive an e-mail acknowledging that we have received your order, but this does not means that your order has been accepted. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail confirms that the Product has been dispatched. The contract between us will only be formed when we send you the Dispatch Confirmation.

2.4. Tracking Number can be found in the shipment email you receive once your order has been dispatched. You can track your order on Carrier’s website provided in the shipment email.

3. Terms of Sale

3.1. We cannot guarantee that every item displayed on our Website is in fact available at the stated price. We will notify you by email and will NOT charge you if you do not acknowledge that you agree to continue with the purchase at the revised price if it exceeds the price displayed when you agreed to the sale.

3.2. We cannot guarantee that every item displayed on our Website is in stock and available for delivery. We will notify you by email and you will NOT be charged for the unavailable products.

3.3. We are not liable for the accuracy or completeness of our product descriptions or the photographs of products and/or our featured product reviews.

3.4. Please check the list of countries that we deliver to in our Delivery Policy before placing an order.

3.5. We accept no liability for items once they have been dispatched. Once orders have been dispatched, we consider the sale to have been completed and the risk of loss is passed onto you.

3.6. Customers accept total responsibility for the goods purchased and use the goods at your own risk.

3.7. These conditions of sale are liable to change at any time and are effective at the time of your specific sale.

3.8. Products displayed with discounted rates are excluded from any other discount, offer and promotion.

3.9. We reserve the right to modify or cancel coupons at any time

4. Cancellation of Order

Your order cannot be canceled once it has been shipped or has entered the shipping process. However, you can typically return the item(s) upon receipt. See our returns & refunds policy for more details.

6. Delivery

We can only deliver to the countries shown in our Delivery Information page. An estimated delivery date for the product will be advised to you when you receive your order confirmation, but this is for reference only. The actual delivery date shall be based on the information provided by the carrier.

We will require a signature at the time of delivery of your order. If the purchaser is not present a person over the age of 18 years of age with authority of the purchaser must be available to accept delivery. If we are unable to make the delivery of your order on the agreed date because there is nobody at the destination specified, it will then be your responsibility to contact us to arrange a new delivery date.

When it has not been possible to deliver your order due to no fault of on our part we reserve the right to make a charge for any further attempt to deliver the order. We will agree the amount of the charge and any payment with you prior to attempting any further delivery of your order.

7. Price and Payment

7.1. The price of the Products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.

7.2. Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

7.3. As our site contains a large number of products, some of the products listed on our site may be incorrectly priced. When a Product’s correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a product’s correct price is higher than the price stated on our website, we &will normally either contact you for instructions before dispatching the product, or reject your order and notify you by e-mail.

7.4. We accept credit or debit card. No cash on Delivery!

8. Promotions

8.1. From time to time we run promotions where discount codes may be issued on our Site, social media channels or e-mail. Only one promotion code can be used per order. Returned item(s) will be refunded with the discount price paid. 

8.2. Promotions apply for the cart value, product or category stated, excluding any shipping fees.

8.3. Free shipping promotions are for Regular Shipping only and are not valid for Express Shipping unless otherwise stated.

8.4. Coupon codes, special offers or promotional price reductions cannot apply to pre-existing orders.

9. Refund Policy

10. Warranty

We warrant to you that any Product purchased from us through our site will, on delivery conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

11. Events outside of our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement that is caused by events outside our reasonable control ("Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

- Strikes, lock-outs or other industrial action

- Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether war declared or not) or threat or preparation for war.

- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster

- Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport

- Impossibility of the use of public or private telecommunication networks

- The acts, decrees, legislation, regulations or restrictions of any government.

We will use our reasonable endeavors to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

12. Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge.
